Erin Bailey, a director with the firm, works exclusively in the area of ERISA, employee benefits and estate planning. She is currently licensed in NC, KY, WV and GA. Her work includes advising clients on qualified retirement plan matters involved in mergers, acquisitions and business sales, including plan terminations, plan mergers and plan spin-offs. In addition, she works with all aspects of designing, drafting, implementing, and maintaining tax-qualified retirement plans. She works with clients to address the needs of key executives, preparing non-qualified deferred compensation arrangements, such as SERPs, restricted stock, stock option and other equity compensation plans. In the welfare benefits area, Erin works with insured plans, self-funded plans, Section 125 plans (cafeteria plans), flexible spending accounts (FSAs) and health reimbursement arrangements (HRAs). Erin advises clients regarding their fiduciary obligations under ERISA as well as COBRA, HIPAA and ACA compliance.
In addition, Erin has experience helping clients navigate the voluntary plan error correction programs offered by the Internal Revenue Service and Department of Labor as well as representing clients in plan audits by the Internal Revenue Service or the Department of Labor.
In the estate planning area, she works on an array of estate planning matters, including the drafting of wills and trusts, and estate administration.
Erin’s prior experience includes work at a large law firm in their Kentucky office as well as several years as in house benefits counsel to a large privately held company.
